Terms of Service

These Terms of Service ("Terms") govern your use of the Flux mobile application ("App"), operated by Flux App ("we", "us", or "our"), located in Toulouse, France. By downloading, installing, or using the App, you agree to be bound by these Terms.

1. App Description

Flux is a men's health and wellness tracker that helps users observe patterns in their energy, mood, libido, sleep quality, stress, and physical training across natural hormonal cycles (circadian, infradian, and seasonal rhythms).

Flux is not a medical device and does not provide medical advice, diagnosis, or treatment. The information provided by the App is for general wellness and informational purposes only. Always consult a qualified healthcare professional for medical decisions.

2. Eligibility

You must be at least 16 years of age to use the App. By using the App, you represent that you meet this age requirement.

3. Account

The App can be used without creating an account. If you choose to create an account (for data synchronization across devices), you are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.

4. Subscriptions and Payments

• Flux offers a free tier with core features and a Premium subscription with additional features.
• Pricing: Premium is available at $19.99 per month or $119.99 per year.
• Free Trial: A 7-day free trial of Premium may be offered to new users. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription.
• Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date.
• Payment: Payment is charged to your Apple App Store or Google Play Store account at confirmation of purchase.
• Cancellation: You may cancel your subscription at any time through your App Store or Google Play Store account settings. Cancellation takes effect at the end of the current billing period. No partial refunds are provided.
• Price Changes: We reserve the right to change subscription prices. Existing subscribers will be notified in advance of any price increase.

5. User Responsibilities

• You agree to use the App only for its intended purpose as a personal wellness tracker.
• You agree not to reverse-engineer, decompile, or disassemble the App.
• You agree not to use the App for any unlawful purpose or in violation of these Terms.
• You are solely responsible for the accuracy of data you enter into the App.

6. Intellectual Property

All content, features, and functionality of the App (including but not limited to text, graphics, logos, icons, algorithms, and software) are the exclusive property of Flux App and are protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any part of the App without prior written consent.

7. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. We make no warranties regarding the accuracy or reliability of any health-related information provided through the App.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Flux App shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, health outcomes, or profits, arising out of or in connection with your use of the App.

In no event shall our total liability exceed the amount you have paid for the App in the 12 months preceding the claim.

9. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination (including intellectual property, disclaimers, and limitations of liability) shall remain in effect.

10. Changes to These Terms

We may update these Terms from time to time. We will notify users of material changes through the App or via email (if an account is registered). Your continued use of the App after such changes constitutes acceptance of the updated Terms.

11. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of France. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Toulouse, France. If you are a consumer within the European Union, you also retain the protection of the mandatory provisions of your country of residence.
